This Marketing Policy explains how DerMo Technologies Inc. (d/b/a Fitlyze) ("Fitlyze", "we", "us", "our") handles marketing communications for our website and Progressive Web App (the "Service"). It is a notice that supplements our Privacy Policy — it is not a contract you need to "accept." Your specific choices are made through the consent options described below. How we use cookies and similar technologies is described in our separate Cookie Policy.
1. Two kinds of messages
- Transactional and service messages — account confirmation, password resets, security and legal-document notices, and other messages needed to operate your account. These are not marketing, are necessary to provide the Service, and cannot be opted out of while you have an account.
- Marketing messages — news, feature updates, tips, and offers. These are optional and are only sent with your consent.
2. Marketing is opt-in
We send marketing emails only with your express prior consent, in line with Canada's Anti-Spam Legislation (CASL), the U.S. CAN-SPAM Act, and applicable EU and Swiss rules. Our opt-in practice goes beyond what CAN-SPAM requires (which permits marketing until you opt out). Consent is given through a separate, optional, un-ticked checkbox (at sign-up or in your settings) — it is never required to use the Service, and we never pre-tick it.
3. How we send marketing, and how to stop it
- We use a third-party email-delivery provider to send our email — Brevo (Sendinblue); the current provider and its location are listed in our Sub-processor & Service Provider List (available in the References section of the User Agreements page, both during sign-up and at any time afterward).
- Every marketing email identifies us as the sender (DerMo Technologies Inc. d/b/a Fitlyze, with our contact details) and includes a one-click unsubscribe link that does not require you to log in.
- We honor unsubscribe requests without delay (within 10 business days at the latest) and at no cost. You can also withdraw consent anytime by emailing privacy@fitlyze.app (subject: "Marketing Unsubscribe").
- Withdrawing marketing consent does not affect transactional or service messages.
- We do not sell your email address or share it with third parties for their own marketing.
4. Measuring our communications
We may use our analytics provider (PostHog - the current provider and its location are listed in our Sub-processor & Service Provider List) to understand, in aggregate, how our messages and features perform (see our Cookie Policy for how analytics work and the choices you have). We do not use this to build advertising profiles, and we do not sell your data.
5. Changes to this Policy
We may update this Policy. If we make material changes, we will notify you by in-app notice or email and, where required, ask for your consent. The effective date above shows when the current version took effect.
