This Health & AI Disclaimer explains the nature and limits of Fitlyze and its AI assistant, and your responsibilities when you use them. It is provided by DerMo Technologies Inc. (d/b/a Fitlyze) ("Fitlyze", "we", "us", "our").
This is a separate document that you must accept to use Fitlyze. It forms part of your agreement with us, together with our Terms of Service, Privacy Policy, and Health Data Policy. Please read it carefully — it affects how you should (and should not) rely on the Service.
1. Fitlyze is a general wellness tool — not medical advice
Fitlyze is a general fitness and wellness application. Its purpose is to help you log activities, food, and body measurements, and to offer general workout and nutrition suggestions for healthy, everyday lifestyle goals.
Fitlyze and its AI assistant do not provide medical advice, diagnosis, treatment, or care, and are not a substitute for a qualified physician, dietitian, nutritionist, therapist, certified trainer, or other professional. Nothing in the Service should be interpreted as a recommendation to start, stop, or change any medical treatment, medication, diet, or exercise program.
2. Fitlyze is not a medical device
Fitlyze is not a medical device and is not intended to diagnose, treat, cure, prevent, monitor, predict, or manage any disease, injury, or medical condition. We are not a regulated healthcare provider, a "health information custodian," or a HIPAA-covered entity. The Service is designed for general wellness and lifestyle purposes only.
3. No professional relationship
Using Fitlyze does not create a doctor–patient, dietitian–client, trainer–client, therapist–client, or any other professional or fiduciary relationship between you and Fitlyze.
4. Talk to a professional first
Consult a qualified healthcare professional before starting, changing, or stopping any diet, nutrition, exercise, or fitness program, and before acting on any suggestion from the Service. This is especially important — and you should get professional clearance first — if you:
- have or suspect any medical condition (for example heart disease, high blood pressure, diabetes, thyroid, kidney, or digestive conditions);
- are pregnant, may be pregnant, or are breastfeeding;
- are recovering from an injury, illness, surgery, or other medical procedure;
- take prescription or over-the-counter medication or supplements;
- have food allergies, intolerances, or specific dietary requirements;
- have, or have a history of, an eating disorder or disordered eating; or
- are over the typical age for, or otherwise at elevated risk during, physical activity.
If you feel unwell, dizzy, in pain, or short of breath at any time, stop and seek medical help.
5. The AI assistant — how it works and its limits
The Fitlyze assistant is an artificial-intelligence system (you are interacting with a machine, not a person). It is powered by a third-party AI model and generates suggestions based on the information you provide by text, photo, or voice, together with your profile details.
Please understand that AI-generated content:
- may be incomplete, inaccurate, outdated, or inappropriate for your individual circumstances;
- may sometimes appear convincing but be wrong (AI can "hallucinate" plausible-sounding information that is incorrect);
- does not reflect your full medical history, lab results, or clinical context, even if you have shared some details;
- includes estimates that are approximate, not exact — including calorie counts, macronutrients, portion sizes, and results from analyzing food photos, nutrition labels, or voice input, which can be misread or miscalculated; and
- is general information for your consideration only, not personalized professional advice.
Do not rely on the AI assistant for medical, diagnostic, emergency, or other high-stakes decisions. Always apply your own judgment and verify important information with a qualified professional.
6. What the AI assistant will not do
The assistant is configured to decline requests outside general wellness, and you should not attempt to use it for them. In particular, it is not designed to and will not:
- diagnose conditions or interpret your symptoms;
- interpret medical tests, lab results, imaging, or clinical measurements;
- create disease-specific or "therapeutic" diet or exercise plans (for example, plans to treat or manage a diagnosed condition);
- advise you to start, stop, dose, or combine medications or supplements as a treatment;
- provide medical guidance for pregnancy, infants or children, or other clinical situations;
- produce dangerously low-calorie, extreme, or restrictive plans, or content that could encourage disordered eating; or
- act as crisis, emergency, or mental-health support.
If you ask for any of the above, the assistant should decline and encourage you to consult a qualified professional. Because Fitlyze is a beta product (see Section 11), these safeguards are still being refined and may not catch everything — if you ever receive content that seems medical, unsafe, or inappropriate, please disregard it and let us know.
7. Nutrition, calorie, and food information
Food, nutrition, and calorie information in the Service — whether you enter it, log it, or obtain it from the AI assistant analyzing a photo or label — is approximate and may be incomplete or wrong. Never rely on the Service for allergy-critical or other safety-critical food decisions. Always check ingredient lists, labels, and allergen information yourself, and confirm with the manufacturer or a professional where it matters to your health.
8. Physical activity carries inherent risk
Exercise and physical activity involve inherent risks, including injury and, in rare cases, serious harm. You are responsible for exercising safely, using proper form and suitable equipment, working within your own limits, and warming up appropriately. Listen to your body and stop if you experience pain, discomfort, or distress.
9. Your responsibility and assumption of risk
You are responsible for any decisions you make and any actions you take based on the Service, including AI-generated suggestions. You use the Service, and act on its content, at your own risk. To the fullest extent permitted by law, Fitlyze is not liable for any outcome resulting from your use of, or reliance on, the Service or its AI outputs. 10. Emergencies and urgent support
Fitlyze and its AI assistant are not for emergencies. If you think you may be experiencing a medical emergency, call your local emergency number or seek immediate in-person medical help — do not use the Service.
If you are in distress, or you are thinking about harming yourself, please contact your local emergency services or a crisis support line in your area, or reach out to someone you trust. You deserve support from a qualified person, which the Service cannot provide.
11. Beta status
Fitlyze is currently a free beta. Features, content, and safety measures are still being developed and tested, and AI suggestions may be more variable than at general release. We appreciate your understanding, and we encourage you to report anything that seems inaccurate, unsafe, or inappropriate.
12. Changes to this Disclaimer
We may update this Disclaimer. If we make material changes, we will notify you by in-app notice or email and, where appropriate, ask you to accept the updated version. The effective date above shows when the current version took effect.
